OPEN MEETING

Lodi Township Board of Trustees meeting opened with the pledge of allegiance to the flag.

 

ATTENDANCE

Present:  Godek, Masters, Foley, Crowner, Lindemann, and Rentschler, Attorney O’Jack, Planning Chair, Jack Steeb and 10 citizens.  Absent Solowczuk.

 

REPORTS

Minutes of the November 6, 2001 board of trustees meeting were approved as moved by Rentschler and seconded by Lindemann.  Motion Carried.

 

Other reports received from the Treasurer, Sheriff, Zoning Inspector and Planning Commission on the November 27, 2001 meeting.

 

NO PUBLIC COMMENT

 

APPROVE AGENDA

Moved Foley, second Masters to approve the agenda with the removal of the Ellsworth Road business, Comcast extension and addition of Little Lexington, discussion on ownership of property to house animals, Thompson McCully and amendments to the budget.  Carried.

 

UNFINISHED BUSINESS

Resolution 2001-009 – Moved Masters, second Foley to adopt the resolution authorizing Supervisor Godek to sign a consent agreement on behalf of the township with the First Unitarian Universalist Church which states that the temporary buildings are to be removed by December 1, 2005.  Roll Call Vote.  Yea:  Foley, Crowner, Masters, Lindemann, Rentschler, and Godek.  Nay:  None.  Absent:  Solowczuk.  Resolution declared adopted.

 

Chris Peterson Home Occupation at 2050 S. Wagner Road was approved as moved by Rentschler and seconded by Crowner.  This is a two year renewable Home Occupation for a mortgage office with 1 employee.  Carried.

 

Supervisor is still looking for a Solid Waste representative for Lodi Township.

 

Ordinance 2001-101 – An ordinance to replace the Lodi Township Traffic Ordinance being the Uniform Traffic Code as amended by adopting by reference the Michigan Vehicle Code, 1949 PA 300, MCL 257.1 to MCL 257.923 as amended, for the purpose of regulating the streets and highways of the Township of Lodi, to set forth the penalties therefor, and to repeal all ordinances or ordinance sections inconsistent thereto.  Moved Masters, second Foley to adopt the ordinance as presented.  Roll Call Vote.  Yea:  Foley, Crowner, Masters, Lindemann, Rentschler and Godek.  Nay:  None.  Absent:  Solowczuk.  Ordinance declared adopted. 

 

Ordinance 2001-102 – An ordinance to protect the public health, safety, and general welfare of Lodi Township by adopting by reference the Motor Carrier Safety Act of 1963, 1963 PA 181, MCL 480.11 ET SEQ., as amended, to replace part 3, “Motor Carrier Safety,” of ordinance No. 95-3, “Vehicle Weight Limit and Motor Carrier Safety Ordinance,” for the purpose of making the provisions consistent with state law, to set forth the penalties therefor, and to repeal all ordinances or ordinance sections inconsistent thereto.  Moved Masters, second Lindemann to adopt the Motor Carrier Safety Act.  Roll Call Vote.  Yea:  Crowner, Masters, Lindemann, Rentschler, Godek, and Foley.  Nay:  None.  Absent:  Solowczuk.  Ordinance declared adopted. 

 

Ellsworth Road Triangle

Comments from board members received concerning the possibility of leased land for a septic system for the 6 houses on Ann Arbor Saline Road that have failing septic systems.  Concerns over leasing land rather that owning it included:  maintenance, bonding, payment of the engineering bills, letter of credit, taxes and assessing to name a few.  Would be a public utility district for the 6 properties only.  Concern about owner of leased land withdrawing the land.  Township ordinance would have to be amended to allow for public system to happen plus township could be liable.  The township would be amending the ordinance just for those 6 houses and once that was done, how many others would want amendments to the ordinance for their interests.  Ayres, Lewis, Norris and May’s Ron Cavallaro is drawing plans for hooking into Pittsfield sewer.  Residents were told to wait for those plans and take them to Pittsfield for possible action.

 

Deppmann Drainage District

Moved Rentschler second Foley to lay the drainage district on the table until the attorney can bring back research on the approval or denial of the district.  Carried.

 

Little Lexington

Discussion held on the on going garage sale being held on the property.  Mr. Crowner recently visited the sale and stated it is like a cheap “Treasure Mart”.  Mr. O’Jack suggested sending a letter to either Mr. Kymal or his attorney or talking with his attorney informally concerning what is happening on the property.

 

Thompson McCully

They have started to remove overburden from the east parcel in order to restore the west parcel.  Township was notified on November 16, 2001.  Concern as to whether they are going deeper that the slopes allowed on the restoration plan was stated.  Engineer is looking into the matter.

 

Leasing property for housing animals.

Ownership must be one owner.  If 5 acres they can have 5 horses on those 5 acres.  We should have a copy of a lease for those acres.  People are leasing a six and seven-acre parcel and a 4-acre parcel where they live.  All parcels are contiguous.  They can have 6 horses on the 6-acre parcel and 7 horses on the 7-acre parcel.  However, they can not have horses on the 4-acre parcel.  No corrals or barns may be built on the 4-acre parcel, they must be on the larger parcels in order to be in compliance with the ordinance. 

 

NEW BUSINESS

Moved Masters, second Foley to renew the 2 year special use permits for Lodi Farms, Abbott’s Landscape Nursery, John Hollowell and Associates, Inc. and Stowaway Self Storage.  Carried.

 

With Foley seconding, Masters moved to pay the fees for the MTA Conference for officials that wish to attend.  Carried.

Moved Foley to sign the contract with Washtenaw County for Internet Service.  Seconded by Crowner, Carried.

 

Discussion on a request to wave charges on a false alarm fee.  We have the property as 100% homestead since 1997, and owner registered to vote 12/97.  He feels that the former resident should be responsible for the 1st false alarm this calendar year.  Need to request information from the resident in order to address the false alarm situation.  However, if he was not a resident, we need to look at his homestead exemption and his voter registration. 

 

Moved Foley, second Godek to move $20 from 201622:804 Tire Recycling to 201622:803 Yard Waste and from 101265:930 Township hall Maintenance to 101440:445 Drain Tax, $6015.00.  Carried.

 

With Lindemann seconding, Masters moved to pay the bills.  Carried.

 

Public Comment

A couple of properties that appear to have active home occupations without permits need to be addressed.

 

No other business brought before the board, the meeting adjourned at 9:30 p.m.

 

Next board meeting will be January 8, 2001 at 7:30 p.m.
