LODI TOWNSHIP BOARD OF TRUSTEES

REGULAR MEETING

JULY 2, 2002

WASHTENAW FARM COUNCIL GROUNDS – BUILDING A

The regular meeting opened at 9:00 p.m. following a Public Hearing on the Extraction Ordinance.

Present: Godek, Masters, Foley, Crowner, Lindemann, Rentschler and Solowczuk. Also present Jesse O’Jack, Attorney; Jack Steeb, Planning Chair; Ron Cavallaro, engineering consultant; and about 75 citizens.

REPORTS

Moved Foley, second Solowczuk to approve the June 4, 2002 minutes as printed. Carried. Reports received from the Treasurer, Sheriff, Planning Commission, Zoning inspector and Fire board.

Moved Solowczuk, second Foley to approve the agenda with the following additions: amend budget, move renewal of home occupations following the revision of the agenda, and address junk cars setting in the township. Carried.

HOME OCCUPATIONS/SPECIAL USE RENEWALS.

Moved Masters, second Lindemann to approve the following home office/special use permits, tabling the Arnold Naebeck permit until the August meeting:

Moved Masters, second Godek to grant Keystone Community Church their special use permit in perpetuity. Carried.

UNFINISHED BUSINESS

Extraction Ordinance

Engineer talked about setbacks and slopes. Ordinance states finished slopes not working slopes.

Godek informed the assembly about the phase two storm water regulations with which parts of Lodi Township will need to comply.

Moved Rentschler, second Solowczuk to establish an escrow account between Lodi Township and individual gravel companies. An annual deposit of .02 cent per ton shall be required. The balance of the estimated restoration cost shall be in the form of a AAA Surety Bond issued by a reputable surety company. The reputable surety company must be listed with the State of Michigan as an authorized company. Restoration cost shall be determined by a mutually agreed reputable engineering company. Roll Call vote: Yea: Masters, Rentschler, Lindemann, Solowczuk. Nay: Godek, Foley, and Crowner. Motion carried.

Moved Foley, second Solowczuk to require Lodi Township to be named as obligee to the AAA rated surety bond with notice to the township 30 days prior to expiration, requiring the bond be renewed 30 days in advance of expiration. Roll Call Vote: Yea: Solowczuk, Masters, Godek, Lindemann, Foley, Crowner and Rentschler. Nay: none. Carried.

Moved Solowczuk second Masters that if Lodi Township does not have a bond in place at this time, a bond must be received by July 19, 2002 in the amount of $250,000 with Lodi Township named as the obligee with other items included as addressed previously.

Crowner moved to amend the motion to require all pits to have a AAA rated bond of $250,000 with Lodi Township to be named as obligee by July 19, 2002. Second Masters. Roll Call vote on amendment. Yea: Solowczuk, Masters, Godek, Lindemann, Foley, Crowner and Rentschler. Nay: None.

Amended motion. To require all pits to have a AAA rated bond of $250,000 with Lodi Township named as obligee by July 19, 2002. Roll Call Vote: Yea: Masters, Solowczuk, Rentschler, Crowner, Godek, Lindemann and Foley. Nay: None. Amended motion carried.

Godek moved, second Crowner to enforce the ordinance on the section on wheel washing. Roll Call Vote: Yea: Crowner, and Godek. Nay: Masters, Solowczuk, Rentschler, Foley and Lindemann. Motion failed.

Moved Rentschler, second Solowczuk to remove wheel washing from the ordinance and require the gravel operator to install a minimum of 800 feet of asphalt or more as needed to keep the road clean. Roll Call Vote: Yea: Lindemann, Rentschler, Solowczuk, Masters and Foley. Nay: Godek and Crowner. Carried.

Discussion held on setbacks. Rentschler offered the following motion. Not withstanding the prohibitions stated in this section, the following shall be permitted. 1). The placement of berms consisting of material that will be used for restoration within the setback requirements if it contributes to the health, safety, and welfare of the township residents in regards to noise, dust, and appearance. Such berms shall be graded and seeded to control dust and erosion. Furthermore, the berm/berms to be determined on an individual basis by the township. 2). Any other use, material, or structure approved as part of the gravel pits restoration plan. Second Solowczuk. Roll Call Vote: Yea: Solowczuk, Lindemann, and Rentschler. Nay: Crowner, Masters, Godek and Foley. Motion failed.

Discussion on enforcement of the gravel ordinance. Foley presented a section on enforcement and penalties. Moved Solowczuk, second Masters to add to next month’s agenda the following items: Berms, setbacks, and enforcement of the Extraction Ordinance. Carried.

NEW BUSINESS

2002 Road Projects

Road projects for 2002. Concern for the seal coat program in Lodi Country Estates and Valley View Estates and the Zeeb Road project was discussed. Residents of Lodi Country Estates requested Lodi Township to contact MDOT and Washtenaw County Road Commission requesting a meeting with them to discuss different ways to maintain their roads rather than seal coating. After much discussion, Moved Masters, second Foley to delay seal coating of Lodi Country Estates numbers 4, 5 and 6 for a year and to do Lodi Country Estates 1 and 3 this year. Motion carried 5-1 with 1 abstention.

Board of Appeals Requests

Moved Solowczuk, second Foley to turn an application by Greg and Kathy Schneider at 3031 Diuble Road for a rear yard variance to the Board of Appeals. Carried.

Moved Foley, second Solowczuk to turn a front yard variance requested by Joseph and Jeanne Learman at 4475 Saline Waterworks Road to the Board of Appeals. Carried.

Home Occupation

The Planning Commission upon completion of removal and maintenance of a clear site distance of her driveway recommended a home occupation request by Lynn Daugherty at 7901 W. Waters Road for approval. Moved Masters, second Lindemann to approve the home occupation with the recommendations of the Planning Commission for 2 years. Carried.

Payment of Bills

Moved Foley, second Crowner to pay the bills presented. Carried.

Authorization to attend workshops

With Foley seconding, Masters moved to authorize trustees or planning commission members to attend the MSU workshop on July 18, 2002 at a cost of $15 per participant. Carried.

Moved Masters, second Crowner to authorize the $249 seminar on land division regulations by the supervisor. Carried.

Moved Masters to authorize trustees or planning commission to attend MTA workshop at a cost of $75. Carried.

PUBLIC COMMENT

None

Pending litigation

Mr. O’Jack requested permission from the board with regard to overweight tickets to agree to reduce fines for technical violations where he finds that such reductions are appropriate, need to be reduced. Moved Godek, second Rentschler to allow Mr. O’Jack the permission requested. Carried

No other business brought before the board, the meeting adjourned at 12:25 a.m. Next board meeting will be August 13, 2002, delayed because of the August 6, 2002 primary election.
