SPECIAL MEETING
JULY 19, 2002 – 8:30 A.M.
Purpose of meeting: Approve extraction ordinance language for publication and discuss enforcement of failure to file bonds.
Present: Godek, Masters, Foley, Crowner, Lindemann, Rentschler and Solowczuk. Also present, Jesse O’Jack, attorney.
Supervisor Godek called the meeting to order at 8:30 a.m.
The meeting notice was read.
ORDINANCE TO AMEND EXTRACTION ORDINANCE #103
This meeting was called to clarify the wording as intended in the motion adopted July 2, 2002, and approve the language changes to the extraction oridnance for publication. Moved Rentschler, second Solowczuk to approve the language in Lodi Township Ordinance 2002-001; an ordinance to amend the Lodi Township extraction regulations, ordinance #103, adopted April 3, 2001 and amended May 1, 2001; by amending section F "Operational Standards," Subsection 2 "Financial Guarantees" to require a surety bond instead of a letter of credit, and subsection 5 "Roads for Ingress and Egress" to require asphalt paving instead of a truck washing system. (Complete copy attached.) Roll Call Vote: Yea: Rentschler, Lindemann, Solowczuk, Masters and Foley. Nay: Crowner and Godek. The ordinance was declared adopted. Published July 25, 2002 and effective July 26, 2002.
Discussion held on Ann Arbor Sand and Gravel. They are currently bringing in material. Moved Masters, second Crowner to authorize Mr. O’Jack to file an injunction immediately against Ann Arbor Sand and Gravel to stop them from bringing materials into the pit without following the ordinance. Roll Call vote: Yea: Rentschler, Masters, Solowczuk, Crowner, Lindemann, Godek and Foley. Carried.
Moved Crowner, second Solowczuk to authorize Mr. O’Jack to go to court seven days following publication of the ordinance amendments if any of the pit operators have not complied with a surety bond as required. Roll Call vote. Yea: Masters, Rentschler, Godek, Foley, Lindemann, Crowner and Solowczuk. Carried.
Moved Foley, second Lindemann to authorize Mr. O’Jack to begin work on filing against anyone who has not filed a bond by noon this day. Carried.
With Crowner seconding, Masters moved to have Mr. O’Jack look at the consent judgment with Ann Arbor Sand and Gravel and have a show cause hearing in regard to the restoration and water samples that are required in the consent judgment, and include an injunction against bringing in material. Carried.
No other business, the meeting adjourned at 9:45 a.m.
