                                                           Ordinance No. 2001-102

 

AN ORDINANCE TO PROTECT THE PUBLIC HEALTH, SAFETY, AND GENERAL WELFARE OF LODI TOWNSHIP BY ADOPTING  BY REFERENCE THE MOTOR CARRIER SAFETY ACT OF 1963, 1963 PA 181, MCL 480.11 ET SEQ., AS AMENDED, TO REPLACE PART 3, “MOTOR CARRIER SAFETY,” OF ORDINANCE NO. 95-3, “VEHICLE WEIGHT LIMIT AND MOTOR CARRIER SAFETY ORDINANCE,” FOR THE PURPOSE OF MAKING THE PROVISIONS CONSISTENT WITH STATE LAW, TO SET FORTH THE PENALTIES THEREFOR, AND TO REPEAL ALL ORDINANCES OR ORDINANCE SECTIONS INCONSISTENT THERETO.                                       

 

THE TOWNSHIP OF LODI, WASHTENAW COUNTY, MICHIGAN ORDAINS:

 

SECTION 1.  Short title.

 

            This ordinance shall be known and may be cited as "The Lodi Township Motor Carrier Safety Ordinance."

 

SECTION 2.   Code adopted.

 

            The Motor Carrier Safety Act of 1963, 1963 PA 181, MCL 480.11 et seq., as amended, is adopted by reference.

 

SECTION 3.   References in code.  

 

            References to “local authorities” shall mean the Township of Lodi.

 

SECTION 4.   Penalties..

 

            The penalties provided in The Motor Carrier Safety Act of 1963, as amended, are adopted by reference, provided, however, that the Township of Lodi may not enforce any provision of The Motor Carrier Safety Act of 1963, as amended, for which the maximum period of imprisonment is greater than 93 days.

 

SECTION 5.   Severability.

 

            If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate provision and such holding shall not affect the validity of the remaining portions.

SECTION 6.  Repeal.

 

            All other Ordinances or sections of Ordinances inconsistent with the provisions of this Ordinance, including Part 3 “Motor Carrier Safety” of Ordinance 95-3, “Vehicle Weight Limit and Motor Carrier Safety Ordinance,” to the extent of such inconsistencies, are hereby repealed.

 

SECTION 7.  Savings clause.

 

            The repeal provided herein shall not abrogate or affect any offense or act committed or done, or any penalty or forfeiture incurred, or any pending fee, assessments, litigation, or prosecution of any right established, occurring prior to the effective date hereof.

 

SECTION 8.   Location statute available for inspection.

 

            A copy of The Motor Carrier Safety Act of 1963, as amended, may be inspected or obtained at the Lodi Township Hall.

 

 

SECTION 9.  Publication and Effective Date.

 

            This ordinance shall be published once in a newspaper having general circulation in Lodi Township and shall take effect 30 days after the first publication of the ordinance.

Masters, being duly elected Clerk for Lodi Township, Washtenaw County, Michigan, state that on December 4, 2001, at a regular meeting of the Lodi Township Board of Trustees, member Masters moved and member Lindemann supported a motion to adopt "The Lodi Township Motor Carrier Safety Ordinance."

 

            The following members voted:

 

            Ayes:    Crowner, Masters, Lindemann, Rentschler, Godek and Foley

           

 

            Nays:   None.
